Welcome to Kyntra Agency. By accessing or using our website, CRM platform, software, AI tools, services, or automations (“Services”), you agree to the following Terms & Conditions. If you do not agree, discontinue use immediately.

1. Definitions

“We,” “us,” “our” refer to Kyntra Agency.
“You,” “Client,” “User” refer to anyone accessing or using our Services.
“Services” include our website, CRM platform, SaaS system, AI messaging tools, voice AI, SMS campaigns, automations, and related tools.

2. Use of Services

You agree to use our Services lawfully and not engage in abuse, hacking, exploitation, or misuse. You must provide accurate information and keep account credentials secure. We may suspend or terminate access if misuse is detected.

3. Client Responsibilities

You are responsible for the data you provide, including contacts and uploaded content. You must comply with all laws such as TCPA, CAN-SPAM, and FCC SMS guidelines.

You may NOT use our platform to send spam, illegal content, harassment, fraudulent messages, or misleading advertising.

4. Payments, Billing & Recurring Charges

• All subscriptions (CRM, SEO, Ads, Social Media, SMS, Voice AI, etc.) are billed on a month-to-month basis unless otherwise specified.
• Subscriptions renew automatically every 30 days.
• If you do not cancel, you will be charged automatically.
• Payments are non-refundable, including partial months or unused service time.
• Failed payments may result in paused or terminated service.

Cancellation Policy:
You may cancel anytime, but cancellations must be submitted at least 7 days before the next billing cycle to avoid being charged again.

5. No Refund Policy

All payments are final and non-refundable. This includes SaaS subscriptions, service retainers, setup fees, SMS campaigns, ad management, custom work, or AI tools.

6. Intellectual Property

All software, branding, automations, scripts, workflows, templates, and training materials belong to Kyntra Agency. You may not copy, resell, duplicate, or reverse engineer any part of our platform or services.

7. Data Ownership

You retain ownership of your customer data and contacts. We do not sell client data. We only access data when required to provide support or improve Services.

8. AI & Automation Disclaimer

You acknowledge that AI tools (SMS bots, chatbots, voice agents, automations) may respond, schedule, tag, or engage with your contacts automatically. You are fully responsible for reviewing, monitoring, and ensuring all outbound communication complies with applicable laws.

9. Limitation of Liability

Kyntra Agency is not liable for loss of business, data loss, missed messages, system downtime, third-party failures, ad performance, compliance issues, or legal penalties resulting from improper use of the platform.

10. Termination

We may suspend or terminate accounts due to misuse, fraudulent activity, repeated failed payments, policy violations, or security concerns. You may cancel anytime following the cancellation rules provided above.

11. Modifications

We reserve the right to update these Terms at any time. Continued use of our Services constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Virginia (or your state of business registration if different).
